Extend the time on a planning permit
Planning permits usually include conditions. Usually the last condition on the planning permit tells you how long the owner has to start the development or use and how long they have to finish the development (an expiry date).
If there is no time limit condition on the permit – this would be unusual – the notes on the back of the planning permit give you information about start and finish dates.
The owner or the occupier of the land may ask Council for an extension of time
- before the permit expires or
- within three months after the permit has expired.
After three months, Council cannot extend the planning permit.
The land owner may apply to the Victorian Civil and Administrative Tribunal for a review of Council's decision to refuse to extend the time of a planning permit.
An application for an extension of time to a planning permit should include:
- the planning permit extension of time application form (DOC 55Kb) including the length of time of the extension sought
- a written explanation of the reasons why the project has not started or finished, and
- the application fee.
Council will send you a letter telling you if the permit has been extended and for how long.
